Understanding Police Investigations

Going to the police station for an interview can feel overwhelming – the stakes are high, and saying the wrong thing to the police can have life-changing consequences. However, you don’t have to talk to the police alone.

During a police investigation, a criminal defence solicitor can help guide you every step of the process:

  • Early Legal Advice: You have the right to talk to a solicitor as soon as you are arrested and detained in the police station. If you are contacted by the police to attend an interview or anticipate that you are going to be arrested, we can provide advice by explaining the procedure, your rights and the allegations made against you.
  • Police Conduct: During the investigation process, police must follow strict rules during interviews, searches, and detention. A solicitor will ensure that your rights are protected and that the police conduct themselves lawfully.
  • Preserving Evidence: CCTV, phone records, and witness statements are all vital in a police investigation. A solicitor can help ensure key evidence that supports your defence is preserved.
  • Interviews by Police: You must have guidance from a solicitor during police interviews. We can advise you when to answer questions, when to remain silent, or what to say in a prepared statement.
  • Bail: If you’re kept in police custody during an investigation, a solicitor can help negotiate your release on bail.

Having an experienced solicitor or accredited representative can help make the process smoother, whether the investigation is for drug offences, motoring offences, or violent offences

Police Investigations Frequently Asked Questions

How much does a solicitor cost for a police interview?

Everyone is entitled to free representation at the police station, the cost of representation is covered by legal aid.

If your police interview is located far outside of London, or you require the representation of a specific solicitor, we may charge you. These costs can vary depending on the type of case and experience of the solicitor. We keep our costs transparent.

Can the police interview me without a lawyer?

The police cannot interview without a lawyer unless you consent to it. You have a right to legal representation during a police interview and if you ask for a solicitor the police must not interview you until one is present.

How long can a police investigation take?

How long a police investigation takes depends on the severity and complexity of the allegation. Police can detain a suspect in the police station for up to 24 hours, sometimes longer if certain conditions apply. If a person is released on police bail, there are restricted periods within which the police can investigate the case. Sometimes suspects are released under investigation where there is no limitation on the length of the investigation.  A  solicitor will be able to advise you how long the investigation is likely to take.
