This was a matter which was initially a family TOLATA dispute. After lengthy litigation, a settlement was reached and this was incorporated into a final order. As part of this order 1% of the property proceeds, which were held by a third party conveyancer, was granted to our client, in addition to payment of around £70,000 in respect of our client’s previous contributions and legal costs. This order was finalised and provided by the court. However, it came to light that the defendant, had attended the third party conveyancer, shown only the part of the order that elaborated 1% of the property proceeds, and got the conveyancer to transfer the remainder of the funds, include the £70,000 owed to our client, to the defendant. We took over the matter at this point, and swiftly moved to demand repayment of the £70,000 to our client, upon refusal and the assertion that the defendant was using the funds, we proceeded swiftly to pursue a freezing injunction against the defendant. Within only a couple of weeks we were able to achieve an ex-parte interim freezing injunction against the defendant, which provided us sufficient security and that the remainder of the £70,000 couldn’t be dissipated and sufficient leverage to negotiate a return of the full sum, securing for our client the full amount owed to them.
